This case involves a dispute between the Utah Division of State Lands and Forestry (the ""Division"") and Trail Mountain Coal Company (""Trail Mountain"") concerning pre-judgment interest and penalties assessed on delinquent lease payments. The lease in question was issued by the State of Utah. It permitted Trail Mountain to mine coal on a parcel of school trust lands near Orangeville, Utah. 1 We granted the Division's petition for review of the Court of Appeals' decision upholding the trial court's ruling that the Division is not entitled to the interest and penalty [921 P2d Page 1367] rates assessed pursuant to regulations of the Board of State Lands and Forestry (the ""Board""). 892 P.2d 13 (Utah 1995). We now reverse. I. PROCEDURAL BACKGROUND
